The Court of Cassation Delivered its Opinion on Adaptation Lawsuits Due to the Pandemic
Lease agreements are among the types of agreements that have been the most heavily impacted by the COVID-19 pandemic (“Pandemic”). The term “Hardship” under Article 138 of the Turkish Code of Obligations (“TCO”) became a disputed issue for lease agreements and tenants filed lawsuits for the adaptation of an agreement due to unforeseen economic problems arising from the Pandemic.
