New Requirement for the Competition Authority to Obtain a Decision from the Judge in Order to Conduct On-Site Inspections
Upon an application made by Ford Otomotiv Sanayi Anonim Şirketi (“Applicant”), in its decision published in the Official Gazette dated 20.06.2023, the Constitutional Court ruled that the Competition Authority’s on-site inspections taking place at an undertakings workplace without a judge’s decision violates the right to immunity of domicile.
